Because the Federal Court refused to block implementation of Berkeley’s landmark cell phone “right to know” ordinance, the CTIA has asked the Ninth Circuit Court of Appeals to issue a preliminary injunction to stop the law from going into effect.

The CTIA claims that cell phone retailers would be harmed by delivering a message they don’t believe, and that the ordinance is likely to be eventually overturned by the courts. According to the Berkeley City Attorney’s office, the law will go into effect on March 21.
